Wage Garnishment

 

In order for wage garnishment to occur, the people you owe must go to the court and obtain the Garnishment Order. This normally happens when you fail to pay off your debts. Exceptions include Credit Unions that you have given an assignment of wage, and Canada Customs and Revenue Agency.

How can you stop a wage garnishment?

You may attempt to convince your creditors to stop the garnishment if you promise to pay back the debt; however, your creditors are not likely to believe you. Creditors garnish those they think will not pay, or those who have not paid in the past.

Several ways to stop wage garnishment include: repaying the debt, filing a proposal to creditors, or as a last resort, personal bankruptcy.

The amount to be garnished from your wages is determined by the court.
